    Our Privacy Commitment

    BobWork AI is built with privacy by design. We handle personal data in line with the major data-protection laws of the markets we serve, including the EU and UK GDPR, the California Consumer Privacy Act (CCPA/CPRA) and Singapore's and Malaysia's PDPA, and respect your rights as a data subject. Your data is yours — we never sell it, never use it to train shared AI models without your consent, and always give you the right to access, correct, or delete it.

    1. Acceptance of Terms

    By accessing or using BobWork AI (the "Service"), operated by BobOffice, LLC ("we", "us", or "our"), you ("User" or "Subscriber") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

    These Terms constitute a legally binding agreement between you and BobOffice, LLC. If you accept them on behalf of a company or other organisation, you confirm you have authority to bind it.

    2. Description of Service

    BobWork AI is an AI-powered omnichannel customer engagement platform that enables businesses to build, train, and deploy AI agents across WhatsApp, Instagram, Facebook Messenger, and web chat. The Service integrates with third-party platforms including but not limited to ChatDaddy, Meta Business APIs, and OpenAI.

    Use of WhatsApp through our Service is subject to Meta's WhatsApp Business Policy and WhatsApp Commerce Policy. You are solely responsible for ensuring your WhatsApp usage complies with all applicable Meta policies.

    3. Subscription Plans and Billing

    BobWork AI is offered on a subscription basis. Subscription fees are billed monthly or annually as selected at sign-up and are non-refundable except where required by applicable consumer protection law.

    • All prices are quoted in US Dollars (USD) unless another currency is displayed at checkout. Applicable sales tax, VAT or GST is added where required by law.
    • Subscriptions auto-renew at the end of each billing cycle unless cancelled at least 24 hours before the renewal date.
    • AI credit usage beyond your plan's included allocation will be billed at the overage rate published on our Pricing page.
    • We reserve the right to change pricing with 30 days' written notice. Continued use after notice constitutes acceptance of the new pricing.

    Payments are processed securely via Stripe. BobWork AI does not store or access your full payment card details.

    4. Account Registration and Security

    You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

    You agree to notify us immediately at info@bobwork.ai of any unauthorised use of your account. We are not liable for losses arising from unauthorised account access resulting from your failure to safeguard your credentials.

    5. Acceptable Use

    You agree not to use the Service to:

    • Send spam, unsolicited messages, or bulk marketing without recipient consent, in breach of applicable anti-spam and data-protection laws (such as the GDPR, CAN-SPAM, TCPA or PDPA).
    • Transmit content that is unlawful, defamatory, obscene, or violates third-party intellectual property rights.
    • Impersonate any person or entity, or misrepresent your affiliation with any organisation.
    • Attempt to reverse-engineer, decompile, or extract the underlying AI models or codebase.
    • Use the Service in any manner that violates WhatsApp's Terms of Service or Meta's Business Policies.
    • Process sensitive personal data (e.g., health records, financial account numbers) through the AI without appropriate safeguards and user consent.

    6. AI-Generated Content

    Responses generated by BobWork AI are produced by artificial intelligence and may not always be accurate, complete, or up to date. You are solely responsible for reviewing, approving, and taking responsibility for all AI-generated content sent to your customers.

    BobWork AI does not guarantee that AI responses will meet regulatory or professional standards in any industry (including healthcare, finance, or legal advice). Do not use the Service as a substitute for professional advice.

    7. Intellectual Property

    The Service, including all software, AI models, interfaces, and branding, is owned by BobOffice, LLC and protected under applicable intellectual property laws worldwide. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes.

    You retain ownership of all content and data you upload to the Service ("Your Content"). By uploading Your Content, you grant us a limited licence to process it for the purpose of delivering the Service to you.

    8. Data Storage and Processing

    Your data is stored on Amazon Web Services (AWS) infrastructure. Primary data is processed in the Asia Pacific (Singapore) region. By using the Service, you consent to the transfer and processing of your data in Singapore and other jurisdictions as necessary to deliver the Service.

    We retain conversation logs, knowledge base content, and account data for up to 12 months after account termination, unless you request earlier deletion in accordance with our Privacy Policy.

    What Data We Collect From You

    • Account details: name, email, company name, phone, billing address.
    • WhatsApp and messaging integration credentials and conversation histories (for AI training).
    • Knowledge base content you upload: documents, URLs, product catalogues, FAQs.
    • Usage analytics: feature interactions, AI credit consumption, session data, and device identifiers.
    • End-customer conversation data routed through your AI agent.

    How We Use Your Data

    • Service delivery — running and improving the BobWork AI platform.
    • Personalised AI agent — your knowledge base and conversation style data train your agent only. We do not use your data to train shared AI models without your explicit written consent.
    • Billing — processing subscription and overage charges via Stripe.
    • Communications — service alerts, security notices, and support responses.
    • Legal compliance — meeting obligations under applicable data-protection and tax laws, and lawful government requests.

    Your Data Rights

    Your Responsibilities as Data Controller

    When you use BobWork AI to handle conversations with your customers, you act as the data controller for your end-customers' personal data, and BobWork AI acts as a data processor on your behalf. You are responsible for:

    • Obtaining valid consent from your end-customers before deploying an AI agent to respond to them.
    • Informing your customers that their messages may be processed by an AI system.
    • Ensuring your use of BobWork AI complies with all laws applicable to your business, including data-protection laws such as the GDPR, CCPA/CPRA and PDPA, and any sector-specific regulations.
    • Responding to any data access or deletion requests from your own customers regarding data held on your account.

    Data Breach Notification

    In the event of a confirmed data breach that affects your personal data or your customers' data, we will notify you within 72 hours of becoming aware of the breach, in accordance with applicable data-protection laws and international best practice. We will provide details of the nature of the breach, the data affected, and the steps we are taking to mitigate harm.

    Cross-Border Data Transfers

    To deliver the Service, your data is processed by subprocessors located in Singapore (AWS), the United States (OpenAI, Stripe), and other jurisdictions. By using BobWork AI, you consent to these transfers. All subprocessors are contractually required to protect your data, and where the law requires it (for example for data from the EU or UK) we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses.

    9. Service Availability

    We target 99.5% monthly uptime for the Service but do not guarantee uninterrupted availability. Scheduled maintenance will be communicated at least 24 hours in advance where possible. We are not liable for downtime caused by third-party service providers (including Meta, ChatDaddy, or OpenAI) or by Force Majeure events.

    10. Limitation of Liability

    To the maximum extent permitted by applicable law, BobOffice, LLC's total liability for any claim arising from or related to the Service shall not exceed the greater of: (a) the amount you paid us in the 3 months preceding the claim, or (b) USD 100.

    We shall not be liable for indirect, incidental, special, consequential, or punitive damages including but not limited to loss of profits, goodwill, data, or business opportunities arising from your use of or inability to use the Service.

    11. Termination

    Either party may terminate the subscription at any time. You may cancel via your account settings or by contacting support. We may suspend or terminate your access immediately if you breach these Terms, violate applicable law, or if required by a third-party platform provider.

    Upon termination, your access to the Service will cease. You may request export of your data within 30 days of termination, after which it may be deleted from our systems.

    12. Governing Law and Dispute Resolution

    These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. Any dispute shall first be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the state or federal courts located in Delaware, which shall have exclusive jurisdiction. Nothing in these Terms removes any mandatory consumer protection you are entitled to under the laws of the country where you live.
